MINUTES FOR JANUARY 4, 2010

Mayor Jones called the meeting to order and led the Pledge of
Allegiance.
Mr. Upchurch gave the invocation.
- Mr. Upchurch made a motion to approve the December 7, 2009
minutes, as written; 2nd by Mr. Cartwright (2-0-2 Mr. Greer and
Mr. Bebber abstained
Mayor Jones opened the floor to Penny Garrett, who proposed a
rare cancer fundraising event in Damascus on July 31, 2010. The
event, titled “Creeper Trail Ride for a Cure”, will
consist of participants riding bicycles, along with a 5k walk through
Town for those who don’t wish to ride, and ending in the
Town Park with a closing ceremony. Banner space will be sold
to individuals who wish to name someone “In Honor Of”,
or “In Memory Of”, and these banners will be displayed
through the Town before and during the event.
Mayor Jones, on behalf of the Council and Town Officials, offered
Mrs. Garrett his appreciation and support of the event.
Mr. Bebber also voiced his support for the cause, and clarified
that the Garretts are donating all proceeds to the benefit of rare
cancer research.
- Mr. Bebber made a motion to approve Mrs. Garrett’s
request to hold the Creeper Trail Ride for a Cure, 2nd
by Mr. Upchurch (4-0).
Mayor Jones opened the floor to Anne Maio, representing the Mt.
Rogers Appalachian Trail Club. Ms. Maio proposed the construction
of a six-sided information kiosk in the Town Park (replacing the
current smaller kiosks), which would include the display of maps
showing the immediate area of the Appalachian Trail, as well as
points of interest in Damascus, and the entire Creeper Trail. The
funding for this project will be available from the unused portion
of grant monies received by the Creeper Trail Club. Ms.
Maio also proposed removing the Damascus Community Park sign, which
is currently in the VDOT right of way, and placing it on top of
the new kiosk once it’s completed.
- Mr. Bebber made a motion to pursue the proposed kiosk project
as presented by Ms. Maio, 2nd by Mr. Cartwright (4-0).
Committee Reports
Budget, Finance and Administration:
Town Treasurer, Bill Pafford, presented the following report:
Taxes are still coming in,
as we approach the January 18th deadline. At this time, we have
collected 67% of the real estate taxes and 60% of the personal
property taxes.
We are winding up the trial
balance audit necessary to start our final audit for the 2008-2009
fiscal year.
We will need to start the purchase and installation
process for the tax program from Southern Software we agreed to
purchase last year. This will need to be in place and up and running
for our new tax year, which will have the first payments due in
May 15, 2010.
- Mr. Cartwright made a motion to authorize the purchase of the
necessary computer software tax package, 2nd by Mr. Bebber (4-0).
Streets, Lights and Maintenance:
Mayor Jones complimented the work of the Maintenance Department
in displaying the Town’s Christmas Lights and decorations.
Mr. Greer reported that the new leaf machine has worked out well
for the department; and they will be picking up Christmas trees
discarded at the curb.
Chief Nunley commended the Maintenance crew for a job well done
in working on the snow covered roads in Town the past month.
Sewer, Water and Sanitation:
Mr. Upchurch reported that Saturday morning it was discovered
that someone had taken bolt-cutters and cut the lock and chain
off of the gate at the Wastewater Treatment Plant. Mr.
Upchurch asked that the area surrounding the facility be patrolled
more frequently, especially on the weekends. Chief Nunley
agreed, and has already been in contact with the Washington County
Sherriff’s Office concerning the issue.
Parks and Recreation:
Mr. Bebber announced that the next combined Parks and Recreation
/ Trail Days meeting will be held on Tuesday, January 19th at 6pm,
in the Town Hall.
Mr. Bebber also reported that he hopes to have the Town pool inspected
in the very near future, weather permitting.
Planning Commission:
Mr. Cartwright reported that the Plannning Commission is trying
to get access granted to the Bayer property for Trail Days parking;
and has approved the final submission to the Washington County
Recreational Park.
Police:
Chief Nunley submitted to the Council a detailed monthly report,
as follows:
The Police Department has
had another productive month. December the 23rd, all full time,
Part time, Auxiliary and explorers delivered Christmas packages
to two elderly citizens in the community. Both residents resided
at Woods Landing in town.
Increased patrols were
conducted during the holidays with no major problems on the roads
other than weather. The Police Department assisted residences that
were without power moving them to emergency shelter at Holston
High School. The Police Department stayed very busy during this
storm assisting the Fire Department and Rescue Squad as well as
directing traffic at several different locations due to trees and
power lines being down.
The Police Department had
its annual Christmas Dinner at the Harbor House in Abingdon on
December 8th, 2009 having a large turnout for the event. The food
and festivities were great. We look forward to doing this every
year.

Chief Nunley reported that Police Department has received $12,500
in grant funding to go toward the purchase of portable defibrillators
for each of the Police vehicles. Also, the Department will
be working with local businesses to obtain current emergency contact
information.
Mr. Bebber thanked the Chief, and the Department, for coming out
to help with the Cavaliers’ playoff game at Emory a few weeks
before.
Special Committees:
Nothing to report at this time.
Citizens Comments
Roger Reedy, a property owner in Town, addressed the Council with
a complaint over the wording on the sewer cut-off notice he recently
received. Mr. Reedy claimed there was an invalid statement
about the W.C.S.A. reconnection fee. Also, he is personally offended
by the part of the notice that informs recipients that if their
water supply gets terminated (due to lack of payment), and they
tamper with it in an attempt to turn it back on themselves, they
are subject to prosecution. Mr. Reedy stated that he took
offense this statement and felt it was an inference of dishonesty;
asking the Council to consider rewording the cut-off notices in
a less offensive manner.
Manager’s Report

Washington County Recreation Park
The County expects construction to be finishing up around the
time of Trail Days.
Bayer Property
Bayer may be interested in allowing the town to use the property
without changing ownership.
Litter Grant
I will provide an update and request guidance on ordering.
Playground Fill Material
The material will be ordered as soon as workload
and weather permits.

Attorney Report
Mr. Dene reported these topics for discussion in closed session:
- Consultation with legal council regarding employment
as the Town’s Wastewater Treatment Plant Superintendent,
per VA Code Sec. 2.2-3371 (A) (1).
Old Business
Mr. Bebber made a motion for the Town Manager to post an ad accepting
bids for the purchase of the remaining unsold police car, 2nd by
Mr. Cartwright (4-0).
New Business
The Damascus Volunteer Fire Department has turned in a bill to
the Town, requesting reimbursement for Town Calls worked in 2009. The
bill includes 33 calls worked (318 man hours @ $5/hour), totaling
$1,590.
- Mr. Cartwright made a motion to table the bill, 2nd by Mr.
Bebber (4-0).
Mayor Jones reminded everyone of the upcoming annual Serum Run
/ Winterfest, which will take place on January 16th.
Consent Agenda
- Mr. Cartwright made a motion to pay the bills, 2nd by Mr. Upchurch
(4-0).
- Mr. Upchurch made a motion to go into closed session, 2nd by
Mr. Cartwright (4-0).
- Motion was made by Mr. Bebber to return to open session, 2nd
by Mr. Cartwright (4-0).
- Motion was made to certify by Mr. Cartwright, 2nd by Mr. Greer
(4-0).
- Mr. Upchurch made a motion to appoint Cindy
Freedman as superintendent of the sewer system
at an annual salary of $31,200, effective January
5, 2010; 2nd by Mr. Greer (4-0).

Mayor Jones called the meeting to order, led the Pledge of Allegiance,
and the invocation.
- Mr. Cartwright made a motion to approve the January 4, 2010 minutes,
as written; 2nd by Mr. Bebber (3-0-2, Mr. Hayes and Mr. Greene abstaining).
Mayor Jones opened the floor to John Henderson, of CSE Insurance. Mr.
Henderson asked the Council for permission to obtain a quote on the Town’s
property and casualty insurance.
- Mr. Bebber made a motion to approve Mr. Henderson’s request
to obtain a quote for insurance, with all bids being submitted
to the Council for review; 2nd by Mr. Greer (4-0-1, Mr. Greene
abstaining).
Mayor Jones opened the floor to Mike Rush, representing People Inc. Mr.
Rush spoke of the proposed tax credit renovation project for the Riverside
Place Apartments. There is an area on the grounds, which is currently being
used for parking, that People Inc. is asking the Town of Damascus to grant
an easement on (in fifteen year increments), so that it may continue to
be utilized after the renovations have been completed.
The Council supported granting the easement, and Mr. Dene agreed to start
the legal proceedings on the matter.
Committee Reports
Budget, Finance and Administration:
Mr. Greene reported that the tax deadline without penalty has passed,
having 85% of the real estate, and 70% of the personal property tax payments
turned in so far.
Mayor Jones asked for a motion to pay a bill turned in last month by the
Damascus Volunteer Fire Department to cover the Town Calls they had worked
in 2009. This bill had been tabled at the January Council Meeting,
and a discussion was held between Council members and Fire Dept. officials,
resulting in an agreement.
- Mr. Greer made a motion to pay the 2009 bill for fire calls, 2nd by
Mr. Bebber (5-0).
Streets, Lights and Maintenance:
Mr. Greer had nothing to report.
Mayor Jones complimented the work of the Maintenance Department for their
hard work in keeping the streets salted and scraped during the recent snowfall.
Sewer, Water and Sanitation:
Mr. Cartwright reported (on behalf of Mr. Upchurch) that Alan Roberts,
who works at the sewer dept., is now certified to perform all the required
testing at the wastewater treatment plant.
A new sewer gas methane meter is needed at the wastewater treatment plant;
the one they currently have is obsolete. Three bids have been collected,
and the best price is $795.
- Mr. Cartwright made a motion to allow the purchase of a new methane
meter, 2nd by Mr. Bebber (5-0).
Parks and Recreation:
Mr. Hayes announced that the next combined Parks and Recreation / Trail
Days meeting will be held on Wednesday February 17th at 6pm, in the Town
Hall.
Vendor applications for Trail Days have been sent out, and preparations
are underway for the planning of that event.
Mr. Bebber reported that Stan Taylor has looked at the pool,
but due to the current weather conditions, couldn't’t make an assessment
of the problem area(s).
Mayor Jones suggested speaking to Joe Straten, of the Washington County
Board of Supervisors, concerning financial assistance from the County with
the Town’s pool repairs.
Mr. Hayes stated he would attempt to contact Mr. Straten concerning funding.
Mr. Hayes also commented that monies collected from the 2010 Trail Days
will probably have to help with the expenses that will be incurred for
repairing the pool.
Planning Commission:
Mr. Sizemore had nothing to report.
Police:
Chief Nunley submitted to the Council a detailed monthly report, as follows:
The Damascus Police Department has
had a busy agenda for the month of January, with no serious incidents with
the last snow storm. Numerous training days have been completed and meetings
attended throughout the month. There has been a high call volume this month
primarily due to weather related incidents.
The Neighborhood Watch conducted
there meeting on January 28th, 2010 where several topics were discussed.
First, they would like to have the opportunity to plant flowers again this
year, by doing so they will need to know how much money will be allotted
to them, if any by the Town to complete this task. The group has planned
to start a fund raiser in the very near future, this fundraiser will be
a raffle for an antique shotgun that has been donated by one of the members
of the Neighborhood Watch. We hope that this goes well and the drawing
will be conducted at the completion of Trail Days.
The Neighborhood Watch also would
like to provide the opportunity for Businesses and individuals in the community
to donate a small amount to the Neighborhood Watch program and in return
a sign with the individuals name or business name will be placed in one
of the flower barrels along town. The Neighborhood watch group would like
to hear the thought of the council in reference to this. Also the Neighborhood
Watch program would like to reserve the Town Park on Columbus Day October
11th, 2010 to have a Town Yard Sale and Craft Sale. The Neighborhood Watch
group will have a small charge for each booth or table that is set up in
the park and all monies received goes to the Neighborhood Watch program.
The Police Department has received
several complaints reference the tree that is located on the South end
of the Town Park. This tree has been struck by several vehicles in the
past few months. The tree does not appear to be in good condition and sets
very close to the edge of the road. Upon speaking with these concerned
individuals, I advised them that I would bring this to the councils attention
during the next Council meeting. Another concern brought to my attention
is trees on the Creeper Trail just past the Town Pool, traveling into town,
that are leaning in the path of riders on the trail.
The Damascus Explorer program is
running well. These young individual now are training for a regional competition
that will be hosted in the summer. They meet four times a month, two of
those being on weekends, preparing for the event. If you know anyone between
the ages of fourteen and twenty one that would like to participate with
this program, please have them contact the Police Department for further
information.
The Police Department has been
working hard with other law enforcement agencies to become one of the top
agencies in providing additional training for all the departments in the
area. For example, the Damascus Police Department will be hosting several
classes in the upcoming months that will be available to all law enforcement
agencies like Fire Investigator Certification starting July 12th, this
will be a three week class and will be conducted at the Bingo Hall on South
Shady Avenue. Other classes being made available are Bicycle safety training
for the public and Police Bicycle certification.
The Police Department
is well under budget for the year and have been fortunate to receive numerous
grants over the last few months. The department has applied for several
other grants but the awards letters have not been received as of this date.
New portable radios for the officers and new automatic external defibrillators
are scheduled to arrive any day. These expensive items were the result
of a Rescue Squad Grant that was made available after receiving our First
Responder licensure. The Police Department in the near future will start
conducting road checks in different areas of the town. This being part
of the Highway Safety Grant. Also the purchase of another digital in-car
camera and radar unit will be placed during the month of February, this
being a part of the same grant. Upon speaking with the State, they assure
that reimbursement time will be much quicker due to changes that have been
made in the last six months.

Citizens Comments
John Henderson commented that the building known as the “Old John
Hamm Store”, on South Shady Ave., is abandoned and unkempt. Mr.
Henderson asked the Council to consider having it torn down.
- Mr. Greene made a motion to refer enforcement of the Town’s
nuisance ordinance to legal council concerning the Ed Hamm building,
2nd by Mr. Greer (5-0).
Manager’s Report
Mr. Sizemore submitted the following report:
A representative of Bayer is planning to come see the property sometime
during the week of the 15th.
Mr. Sizemore also informed the Council of a property management
agency (GEM) that has acquired Oak Knoll Apartments, and is looking to
secure funding for renovations and upgrades involved in a tax credit program. Mel
Melton, of GEM, is asking for the Council’s approval for the company
to peruse this project.
The Council voiced their approval of the proposed rehabilitation
project to the property.
Attorney Report
Mr. Dene reported these topics for discussion in closed session:

New Business
Town Hall has received several inquiries of people asking permission to
take some of the white ducks in town; which Council agreed is fine because
the white ones are not protected under federal or state law, or classified
as Town property.
Shenandoah Mountain Touring is asking for the Council’s permission
to host the Iron Mountain 100K Mountain Bike Event again this year, the
second weekend in July. The Council agreed to allow the proposed
event again.
- Mr. Bebber made a motion to waive the gazebo rental fee for the event,
2nd by Mr. Greene (5-0).
The Abingdon Area Ministerial Association is requesting the use of the
park for a fundraiser on April 17th; and has asked that the fee to reserve
the gazebo be waived.
- Mr. Bebber made a motion to waive the gazebo rental fee for the event,

Mayor Jones called the meeting to order, led the Pledge of Allegiance,

- Mr. Greer made a motion to approve the February 1, 2010 minutes
as written; 2nd by Mr. Bebber (4-0, Mr. Greene not yet present).
Committee Reports
Budget, Finance and Administration:
The Town has an equity loan through the Bank
of Damascus in the amount of $44,000. Mayor Jones suggested
paying it off in two separate installments.
- Mr. Hayes made a motion to repay the note with two payments,
2nd by Mr. Greer (4-0, Mr. Greene not yet present).
Streets, Lights and Maintenance:
Mr. Greer proposed purchasing two vehicles from the Virginia
State Surplus Department; one for the Public Works Dept., and
one for the Sewer Dept. for a total cost of $2700. To offset
the cost of these vehicles, Mr. Greer suggested selling (via
sealed bids) three of the vehicles currently owned by the town;
one used by the Public Works Dept., and two used by the Sewer
Dept.
- Mr. Greer made a motion to buy the two proposed vehicles,
and sell the other three; 2nd by Mr. Upchurch (4-0-1 Mr. Greene
abstained).
Mr. Greer complimented the Public Works Dept. for working diligently
on the roadways during the recent snowfalls.
Sewer, Water and Sanitation:
Mr. Upchurch reported that the underground tank has been removed
and a new above ground tank has been installed; and the generator
is now on-line and ready to use. Also, Alan Roberts has
received the certification required for water testing, etc…
Mr. Greer asked if there is a way to adjust sewer bills for
residents who have had a water line break between the meter and
the house, and could prove that there was a break and it has
been fixed. In this situation the water would be passing
through the meter (causing the bill to increase), but not actually
going into the home, or being used.
Mayor Jones answered that the sewer bills are based solely on
the water readings (from the meters) sent to the Town by the
W.C.S.A., and there is no other method of billing in place.
The Council had a discussion on the topic and decided to turn
it over to the Sewer Committee for discussion at their next scheduled
meeting.
Parks and Recreation:
- Mr. Hayes made a motion to approve the budgeted Trail Days
funds, 2nd by Mr. Greer (5-0).
Mr. Hayes also reported that the condition of the Town Pool
has deteriorated, and must be inspected when the weather permits.
Planning Commission:
Mr. Cartwright reported that the lumber being piled up on the
old basketball court (on Wilson St.) is going to be used for
repair on the Creeper Trail bridges in the upcoming months.
Police:
Chief Nunley submitted to the Council a detailed monthly report,
as follows:
The month of February has
been busy for the Police Department, primarily due to weather
related incidents causing an increase for calls for service.
Due to weather, the monthly Neighborhood Watch meeting was cancelled,
as well as some of the training events scheduled for the Explorer
Post.
The 1997 Chevrolet Astro
Van now parked in the rear lot was confiscated in November 2009
during a narcotic arrest in town. The vehicle has 118,000 miles
and appears to be in good running condition. This vehicle has
been awarded to the Town of Damascus by the courts. This judgment
will be final on April 30th, 2010 after the completion of the
Circuit Court ruling. The Town of Damascus will own this vehicle
until the decision is made to sell. When the vehicle is sold,
the Town of Damascus will receive 33 and one third percent of
the amount received. The Commonwealth Attorneys Office and Department
of Criminal Justice Services will receive the same.
Due to the weather, the
Police Department has not been able to participate in the Click
it or Ticket, or any of the other highway safety campaigns, but
is scheduled to start during the month of March. This includes
additional saturation patrols and road checks. The portable radar
sign that was used during April and May of 2009 is scheduled
to be back in town during the month of April, if not earlier.

We will be able to use this sign for approximately three weeks
before it will have to be returned to the state.

Citizens Comments
Eleanor Grasselli asked when construction will start on the
Beaverdam Creek Trail project.
Mr. Sizemore answered that a timeline on that specific project
has not been specified yet.
Russell McBride commended Cindy Freedman (Sewer Plant Superintendant)
on a job well done on a project at one of his properties. Mr.
McBride also submitted a letter of appreciation for Ms. Freedman.
Manager’s Report
Mr. Sizemore submitted the following report:
OLD BUSINESS
Washington County Recreation Park
Construction on the ballparks is planned to start mid March.
Bayer Property
The Bayer property is now owned by a company called Lanxis.
I have spoken to an environmental representative for Lanxis about
using that property during Trail Days, and have been told that
we cannot for liability reasons.
Playground Fill Material
The material will be ordered as soon as workload
and weather permits.
NEW BUISNESS
Police Car Bids
Bids have been received for the remaining surplus
police car. I will have a bid tabulation sheet ready at the council
meeting.
The results of the bids for the surplus 2003 Ford Crown Vic.,
ranging from lowest to highest, are: $320, $500, and $502.
- Mr. Hayes made a motion to accept the highest bid, 2nd by
Mr. Bebber (5-0).
Attorney Report
Mr. Dene reported the following requests of People Inc. as such:
- Town of Damascus to release a ten year property lien, which
has been expired for approximately ten years.
- Mr. Greer made a motion for the Town of Damascus to release
the lien on the Rock School Property (record in the Clerks
Office in the Circuit Court of Washington Co. VA; Deed Book
790, pg 679); 2nd by Mr. Upchurch (5-0).
- Mayor of Damascus to execute the certificate and affidavit
of satisfaction that have been submitted by People Inc.
- Mr. Bebber made a motion authorizing and directing the
Mayor to sign the above mentioned affidavit, 2nd by Mr. Greer
(5-0).
- A waiver and release of the Town’s right of first refusal
on the property (in such a way that it can be recorded in the
County Clerk’s Office), which the Council discussed
and voted in favor of at the August 2009 Council
Meeting.
- Mr. Hayes made a motion to approve and accept the waiver
and release of right of first refusal prepared and submitted
by People Inc. of Virginia, 2nd by Mr. Bebber (5-0).
- Mayor of Damascus to execute the waiver and release of the
right of first refusal on behalf of the Town.
- Mr. Bebber made a motion authorizing and directing
the Mayor to execute the waiver and release of
the right of first refusal, 2nd by Mr. Greer
(5-0).
Mr. Dene also reported that People Inc. has also requested a
legal, enforceable, and recordable right to park on an area (40ft
strip) of the property located behind the Rock School. To
do so will require the Town to hold a public hearing on the possibility
of issuing a property easement or transfer.
The Council decided to schedule the public hearing for March
25th at 6:30pm.

- Consultation with legal council regarding the parking ordinance,
and the administration of parking during Trail Days, per VA

The ‘Round the Mountain’ Artisan Network has submitted
a funding support request of $200.
- Mr. Greene made a motion to table the request until a budget
review is complete, 2nd by Mr. Hayes (5-0).
