Mayor McCrady called the meeting to order, led the Pledge of Allegiance,
and asked Rev. Wayne Guynn to give the invocation.
- Mr. Upchurch made a motion to approve the June 7, 2010 Regular
Council Meeting minutes as written; 2nd by Mr. Bebber (5-0-1
Mr. Morgan abstained).
- Mr. Upchurch made a motion to approve the June 21, 2010 Special
Called Council Meeting minutes as written; 2nd by Mr. Greer (5-0-1
Mr. Morgan abstained).
Melanie Gooch, representing Owens CPA & Associates PC, gave
an audit report for the FY08-09. Mrs. Gooch reported finding
no deficiencies in the financial practices of the Town of Damascus.
- Mr. Bebber made a motion to accept the audit and financial
statement as presented, 2nd by Mr. Greer (6-0).
Committee Reports
Budget, Finance and Administration:
- Mr. Greene made a motion to accept a proposed written agreement
with Hungate Business Services to provide 1 year service
on the Town’s Allworx phone system, a 4 year software
upgrade key, and a 4 year hardware warranty; 2nd by Mr. Bebber
(6-0).
Town Treasurer, Bill Pafford, suggested placing $100,000 into
a CD to draw interest. The Council agreed to consider this
option.
Streets, Lights and Maintenance:
Mr. Greer reported that the Maintenance Dept. has replaced a storm
drain at Laurel and Beaverdam Ave. Also, they have cleaned
and widened Ena St. and Rutledge St. in preparation for the paving
crew. There are plans in the works to clear the right-of-way
at Bone Hollow Rd. and Appalachian Trail Drive. The Maintenance
crew has started coming in at 6am in an effort to get a lot of
work done before the heat of the day.
Sewer, Water and Sanitation:
Mr. Upchurch reported that the Town of Abingdon sent their camera
crew (with a robotic camera), to be navigated through the sewer
mains. The camera detected numerous cracks in the main
on Second St., indicating that is where excess surface water
is entering the sewer system. Mr. Upchurch advised that
the entire line needs to be replaced.
Parks and Recreation:
Mr. Hayes reported that the July 3rd Independence Day festivities
were a great success, possibly drawing the largest crowd yet.
Mr. Hayes inquired about the status of information from the pool
repair specialist.
Mr. Bebber advised there could possibly be a pressure test done
on the pool within the next two weeks to help determine the extent
of the breakdown, and therefore the most effective method of repair
to proceed with.
Planning Commission:
Nothing to report at this time.
Police:
Chief Nunley submitted to the Council a detailed monthly report,
as follows:
The Damascus Police Department has had another busy month with
the warm weather, Creeper Trail traffic and the celebration of
Independence Day. Festivities in the park on Saturday night went
very well. Traffic was cleared out relatively quickly, and no major
calls were received reference to the crowd. Numerous fireworks
complaints were received over the weekend but each call was answered
with no problems reported.
The Chevy Astro Van from the narcotic seizure has been placed into service.
The department is looking into the possibility of having this vehicle wrapped
in vinyl with pictures of the town placed on both sides. If anyone has a picture
in mind that you would like us to use feel free to contact us. Neighborhood
Watch and the Explorer programs have conducted there monthly meetings with
good results. The Neighborhood Watch drawing for a shotgun on July 4th was
won by Robert Fritz of Damascus.
Numerous Law Enforcement agencies will be in town for the remainder of
the month for the Fire Investigator training that the Damascus Police Department
is hosting at the Bingo Hall on South Shady Avenue. This training will last
until July 30th and is the date that all persons in the class will do final
testing. The media has contacted the Police Department requesting a press release
as this training has never previously been available in this part of the state.
An agreement has been reached between the Fire Department and the Police
Department in reference to the old jail cells in the back of Town Hall. The
Police Department will be moving equipment and evidence into this area in the
next few weeks. The Fire Department will be purchasing a storage container
for their additional equipment to free this area for our needs.
The mobile radar sign used throughout town has been returned to the state.
Therefore you will be seeing the decoy police car in different locations throughout
town. If you have an area you would like this car to be placed, feel free to
contact me or any other member of the department. Many complaint areas still
exist in reference to speeding. Officers are running stationary and moving
radar in these areas attempting to slow traffic down. The most prominent area
is South Shady Avenue where several speeding violations have been issued.
As always, feel free to contact me anytime with any questions or
concerns.
Special Committees:
Richard Smith, representing the ADam Committee, Reported on the
status of a new wireless antennae which is now in place (on top
of Town Hall) and operational for a couple of blocks. There
are plans in place to extend the wireless coverage, as funding
becomes available.
Citizens Comments
Geneva Campbell, of 17 Mock Avenue, requested the Town install
2 new signs in the Town Park: one requesting pet owners, who have
their pets in the Park, to clean up their pet’s waste; and
another sign to allow for children only on the playground
equipment. Ms. Campbell also reported the construction site
of the Veterans Memorial is grown up with weeds, and needs to be
mowed. (Mr. Morgan reported it being mowed earlier in the
day). Also, Ms. Campbell inquired if the Mayor had plans
to work toward securing tax breaks for new home owners in Town.
Mayor McCrady announced his plan to hold an open Town meeting
on July 21st at 7pm, for citizens to voice their interests and
suggestions for the Town of Damascus.
Uneva Johnson, of S. Shady Ave., commented that there seem to
be a number of people living in Town, and driving on out-of-state
license plates.
Chief Nunley replied that after 30 days of residence, it is a moving
violation of the vehicle to not have it tagged properly.
Ms. Johnson suggested the Council require anyone who puts out a
yard sale sign, remove the sign immediately following the sale.
Also, Ms. Johnson inquired about the person or group in charge
of tending the flowers in the Town’s planters, because they
need to be watered more frequently. Chief Nunley responded
that the Neighborhood Watch group volunteers for that need, and
are working on it as they get time.
Shirley Brand, of 124 Commerce St., commended Chief Nunley and
the Damascus Police Department, for the outstanding job they do
for the community.
John Henderson, of 1120 S. Shady Ave., asked the Council about
the status of a request he had made in February to have a dilapidated
building removed from the Hamm property on S. Shady Ave.
Town Attorney, Thomas Dene replied that he is still gathering information
on the property in question because it seems to have multiple owners/interests.
Manager’s Report
Mr. Sizemore submitted the following report:
OLD BUSINESS
Washington County Recreation Park
The park is under construction, and no completion date has been
given at this time.
Pool Repair
Stan Taylor has looked at the pool and will get back to us with
an answer.
NEW BUSINESS
2010 Paving
Ena St. has been paved, and Rutledge has been cleared and is ready
for paving.
Mower bids
The following mower was put out for bids: 1989 WOODS model #2860,
Zero turn riding mower, 3 cyl. Kubota diesel engine, with a 52” mowing
deck. There were three bids submitted, and the high bid
was $357.95.
- Mr. Greer made a motion to accept the highest bid, 2nd by Mr.
Upchurch (6-0).
Flood Ordinance
Flood Ordinance changes are required before the Town can adopt
the new FIRM maps. These changes are minimum requirements and
will be provided for adoption at a later date.
Attorney Report
Mr. Dene advised the Council that a series of meetings/public
hearings will be necessary to initiate the process of amending
the flood plane ordinance, and suggested combining some of the
meetings with ones already scheduled.
- Mr. Greene made a motion initiate the process of amending the
flood plane ordinance by holding a joint Public Hearing at 6:00,
Planning Commission meeting at 6:30, and the regular scheduled
Council meeting at 7:00 on Monday Sept. 13th; 2nd by Mr. Upchurch
(6-0).
Mr. Dene reported the following topics for discussion in closed
session:
- Consultation with legal Counsel regarding VRS pension liability,
per VA Code Sec. 2.2-3711 (A) (7).
- Consultation with legal Counsel regarding utilities provision
for the Bayer property, per VA Code Sec. 2.2-3711 (A) (7).
- Consultation with legal Counsel regarding possible abatement
of nuisance properties, per VA Code Sec. 2.2-3711 (A) (7).
Old Business
Mr. Bebber reported that a design is being developed to go on
four permanent signs, to be placed at the points marking Town limits,
celebrating specific sports achievements. This had been approved
by the Council a few years ago, just not followed up on until now.
New Business
APPOINTMENTS and REAPPOINTMENTS
* Mr. Greene expressed his wish to relinquish the position of Vice
Mayor, and suggested the Council appoint Mr. Morgan to that position. The
Council agreed, and Mr. Morgan accepted.

- Mr. Bebber made a motion to accept these appointments, 2nd
by Mr. Greer (6-0).
On Sept. 18th the annual St. Jude Bike-A-Thon, hosted by Peuther
Chapel Church, will take place in Damascus and will begin and end
in the Park. The group has requested the gazebo fee be waived
for the fundraiser.
- Mr. Hayes made a motion to waive the gazebo fee for the St.
Jude Bike-A-Thon, 2nd by Mr. Upchurch (6-0).

Mayor McCrady called the meeting to order, led the Pledge of Allegiance,
and gave the invocation.
- Mr. Upchurch made a motion to approve the July 12, 2010 Regular
Council Meeting minutes as written; 2nd by Mr. Morgan (4-0).
VML Award Presentation:
On Monday, August 2, 2010, Harry McMillen, Member Services Specialist
of VML Insurance Programs, presented the 2010 Risk Management
Performance Award to the Town of Damascus at their council meeting.
VML Insurance Programs is a non profit, group self insurance program
of local governments in the Commonwealth of Virginia. The
Town of Damascus has been a member since 1985. The Town is
insured for property, auto, liability, and workers’ compensation
coverage in VML Insurance Programs.
Damascus is one of seven members out of more than 465, recognized
for their excellence in risk management.
The Town has been a frequent participant in training programs provided
by VML Insurance Programs. Police Chief William Nunley and
Police Officer William Carmickle have attended training on legal
issues connected with law enforcement. The Town Treasurer, Bill
Pafford, has attended several training sessions on safety and claims
management issues.
The Town has fully complied with all recommendations of the Risk
Management Guidelines issued by VML Insurance Programs. The Town
has an overall 20% loss ratio which compares very favorably with
the program average of 65%.
The approach that the Town of Damascus has taken toward loss prevention
and good claim management practices has earned this recognition. The
support and the direction from your Town Treasurer and Risk Manager,
Bill Pafford, has helped make the Town a safer place in which to
work and live.
The award was received by the Honorable Mayor, Jack R. McCrady,
Jr. on behalf of the employees and citizens of the Town of Damascus.
Committee Reports
Budget, Finance and Administration:
Mr. Greene referenced the following report, which was submitted
by the Town Treasurer:
Our pre-audit for the 2009-2010 fiscal year is tentatively scheduled
to begin in mid-august. This will allow for completion of our required
financial audit much earlier than the last several years.
We have been exploring the possibility of implementing direct deposit
for town employees. The cost would be approximately $70 per month.
This would be available for all employees, the council and mayor.
Our existing payroll package from Southern Software is fully compatible
with the requirements of BB&T for submission of the necessary
files. Direct deposit would be an advantage for those employees
who do not work a regular shift (such as the police department)
and may not be on working on payday, employees on vacation or out
of town, and those who do not bank in Damascus. In addition, BB&T
would offer each employee a free checking account and other benefits
at no additional cost to the employee or the town.
- Mr. Greene made a motion to move forward with implementing
the direct deposit payroll system, 2nd by Mr. Greer (4-0).
Streets, Lights and Maintenance:
Mr. Greer reported the Public Works Dept. has been busy with regular
upkeep and maintenance of the Town’s right-of-ways, properties,
and facilities.
Sewer, Water and Sanitation:
Mr. Upchurch reported the Sewer Dept. is having trouble with scum
building up on top of the treatment plant water, as it always
does in the summer time. There have been problems with
the computer at the plant, and may need to be fixed or replaced.
As reported last month, there was a video camera ran through
the sewer mains in an effort to detect water leaks. When
the Sewer Dept. received the video it was blank, so the process
will be redone.
Parks and Recreation:
Nothing to report at this time.
Planning Commission:
Nothing to report at this time.
Police:
Chief Nunley submitted to the Council a detailed monthly report,
as follows:
The Damascus Police Department has had another busy agenda for
the month of July. The Town has had a large amount of visitors
due to the weather and time of year. Several officers have received
additional training in different fields, including all officers
now certified in Active Shooter Response, Forensic Science Breath
Alcohol Operators certification and each officer within the Department
is now Emergency Medical Technician basic or higher.
The Police Department has worked hard in complaint areas reference to
speeding during the month of July. Numerous speeding violations have been issued
during this time. The average monthly speeding tickets are now at 16 miles
per hour over the posted speed limit. The Police Department has received several
thank you comments from the citizens that live in these areas.
The Police Department has received possession of the old jail cells from
the Fire Department. We are in the process of making the necessary maintenance
modifications to make this move. Our plan is to have this as an evidence room
and be fully operational in two weeks. All work will be conducted by our staff
with no additional expenses to the Town.
Reimbursement monies have been received from the State reference to our
last grant cycle. $2,423.64 was received this month leaving a zero balance
owed by the State. August 3rd, 2010 I will be attending a conference to see
what State grants our department has been awarded by the Virginia Highway Safety
Administration. Also, for your information the scheduled Fire and Arson Investigation
Class has been cancelled due to lack of participants from other agencies. This
class is rescheduled to begin January 31st, 2011 here in Damascus.

Special Committees:
Penny Garrett and Olivia French, on behalf of the “Creeper
Trail Ride For A Cure”, reported on a very successful first-time
event, and their wish to make it an annual occurrence. The
monetary goal was to raise $50k to benefit rare cancer research,
and actual collections have exceeded $90k. Mrs. Garrett and
Ms. French extended their appreciation to the Town Council, Town
employees, local businesses, and individuals who supported the
event. For more information, the website may be accessed

Anne Maio, on behalf of the Appalachian Trail “AT” Community,
suggested the Town of Damascus apply to the Appalachian Trail Conservancy(ATC)
to be recognized officially as an AT Community. Handouts
were provided that detailed the benefits of holding this recognition;
as well as the application and criteria for selection.
- Mr. Greene made a motion to begin the process of applying to
the ATC for recognition as an AT Community, 2nd by Mr. Greer
(4-0).

PROCLAMATION
A proclamation
to designate August 14, 2010 “South Holston Lake & River Cleanup
Day” in Damascus, Virginia and to commend area residents for their 18th
annual efforts.
WHEREAS,
the second Saturday in August has been established as the day residents of
Northeast Tennessee and Southwest Virginia should participate in the “18th
Annual South Holston Lake Cleanup;” this day should carry a desire and
purpose to add beauty and a natural appearance to the landscape through cleanup
efforts; and
WHEREAS,
at a time when public lands and waterways are being reduced at an alarming
rate; volunteer cleanup activities are one of the most important we can undertake
to assure America’s beauty; and
WHEREAS,
a clean environment is a legacy to our future; each man, woman and child of
this region is encouraged to make an invaluable contribution to the lives of
future generations,
NOW,
THEREFORE, BE IT PROCLAIMED BY THE TOWN OF DAMASCUSS, VIRGINIA, that

Washington County Service Authority Easement
The Washington County Service Authority is requesting an easement
for construction and maintenance of a water line to the Damascus
Tourism Center and Library. The easement and map are attached.
RIGHT-OF WAY EASEMENT
THIS
RIGHT OF WAY EASEMENT made and entered into this ________ day of _______________,
2010, by and between the TOWN OF DAMASCUS, hereinafter referred to as “Landowner,” and
the Washington County Service Authority, hereinafter referred to as “WCSA”:
W I T N E S S E T H:
That
for and in consideration of One Dollar ($1.00) cash in hand paid to the Landowner
by WCSA and other good and valuable consideration, the receipt of which is
hereby acknowledged, the Landowner does hereby grant and convey with General
Warranty to WCSA and its successors and assigns forever the following property:
A
forty (40) foot temporary and twenty (20) foot permanent water easement for
the installation, maintenance, operation, and repair of water facilities, which
easement is beneath, upon, and over the real property. This permanent easement
is situated in the Taylor Magisterial District on Tax Parcel Number 172B1-A-147
as shown on a sketch of easement attached hereto.
Landowner
further understands and agrees as follows:
1. All
facilities, public works, and appurtenances which are installed in or on said
property now or in the future by or for WCSA shall be and remain the property
of WCSA and no charge shall at any time be made by the Landowner for the use
of the property occupied by WCSA or for the privilege of constructing, maintaining
and operating said facilities and the necessary or appropriate appurtenances.
2. WCSA
and its agents and employees, for the purpose of inspecting, maintaining or
operating its facilities, shall have the right and easement of ingress and
egress over any lands of the Landowner adjacent to the described easement between
any public or private roads and the described easement in such manner as shall
occasion the least practicable damage and inconvenience to Landowner.
3. WCSA
shall have the right to inspect, rebuild, repair, change, alter and install
such additional or substitute lines or facilities within the easement herein
granted as WCSA may from time to time deem advisable or expedient, and shall
have such rights and privileges as may be reasonably necessary for the full
enjoyment or use for any of the aforesaid purposes of the easement and rights
herein granted.
4. WCSA
shall repair or replace only ground cover now on the said easement which may
be disturbed, damaged, or removed as a result of the construction of any of
WCSA’s facilities, shall remove all trash and other debris of construction
or repair from the easement, and shall restore the surface thereof to its original
condition.
5. Landowner
reserves the right to make use of the land subject to the rights herein granted,
which use shall not be inconsistent with the rights herein conveyed or interfere
with the use of the said easement by WCSA for the purposes aforesaid, provided,
however, that all such use shall be at Landowner’s risk unless prior
written approval of WCSA is obtained and provided further that this paragraph
shall not apply to property conveyed in fee simple.
6. Whether
or not the easement herein conveyed is exclusive, no other party shall be granted
the right to use or shall use any part of the area within such easement for
any purpose or in any manner until after a review and a finding by WCSA in
writing that such use will not be in conflict with, or inconvenient to, WCSA’s
use thereof or the purpose for which such easement was granted.
7. This
instrument covers all the agreements between the parties and no representations
or statements, verbal or written, have been made which are inconsistent with
the terms of this deed.

- Mr. Greene made a motion to hold a Special Called Council Meeting
on Wednesday August 25th at 6pm concerning the proposed right-of-way
easement, 2nd by Mr. Greer (4-0).
Mr. Sizemore reported one opening on the Planning Commission.
- Mr. Greene made a motion to appoint Mr. Morgan to the Planning
Commission, 2nd by Mr. Greer (3-0-1 Mr. Morgan abstainied).
Mr. Sizemore also reported one opening on the Board of Zoning
Appeals. Recommendations are being accepted.
Mayor McCrady asked Mr. Sizemore to attain an official estimate
or cost of repair for the Town pool, so that the Council can look
at an official cost analysis.
Attorney Report
Mr. Dene reported that in 2006 the Town of Damascus made an agreement
with the Washington County Service Authority (WCSA) concerning
the sale of some property to build a pump station on. The
transaction was made, but the deed was not recorded and the original
cannot be found. Mr. Dene produced a substitute deed in
which to convey the property to the WCSA.
- Mr. Greer made a motion to authorize and direct
the Mayor to execute the substitute deed for the WCSA,
2nd by Mr. Greene (4-0).
Mr. Dene asked for an item correction in the July minutes (to
ensure compliance with FOIA), specifying the motion to go into
closed session for consideration of the matters identified by Legal
Council.
- Mr. Greer made a motion to amend the official July minutes
to reflect the correct language necessary for FOIA compliance
as stated above, 2nd by Mr. Upchurch (4-0).
Mr. Dene advised the Council of the upcoming meeting schedule
as follows:
Wednesday Aug. 25th
6:00: Public Hearing and Special Called Council
Meeting concerning a right-of-way easement for the Washington
County Service Authority (in reference to a proposed water line
for the future Damascus Visitor’s Center / Branch Library)
Monday Sept. 13th
6:00: Joint Public Hearing and Town Council Meeting
to receive comment concerning amending the floodplain ordinance
to reflect changes that are necessary before the Town can adopt
the new Flood Insurance Rate Maps.
6:30: Planning Commission Meeting
7:00: Regular Scheduled Council Meeting

Town Treasurer Bill Pafford had inquired at the July Council Meeting
about placing $100k into a short term CD at BB&T.
Mr. Greene stated the Budget, Finance, and Administration Committee
supports this recommendation.
- Mr. Greene made a motion to place $100,000 from the Town’s
general fund into a short term CD with BB&T, 2nd by
Mr. Greer (4-0).
